JAM ACTIVITY CAMPS BOOKING TERMS AND CONDITIONS
Upon making a booking with JAM Activity Camps, you enter into an agreement governed by the following conditions. We are committed to fostering a positive relationship, and in case of concerns or unmet expectations, we aim to address them promptly. 1. PAYMENT TERMS AND BOOKING CONFIRMATION
1.1 The agreement between you and JAM Activity Camps commences upon payment, in part or in full, marking the initiation of these booking conditions. This agreement pertains to the individual making the booking, and if this person is not the parent or guardian of the attending child(ren), it is your responsibility to ensure they understand these conditions. Confirmations for online, phone, or email bookings will be sent via email.
1.2 Review your booking confirmation for accuracy, including dates, location, and child details. The accuracy of booking details rests with the person making the reservation. As consumer rights apply differently to services with specific dates, the 14-day cooling-off period does not apply. However, if your confirmation differs from expectations, notify us within 48 hours, and we'll strive to make adjustments. After 48 hours, our standard cancellation and amendment terms apply.
1.3 JAM Activity Camps accepts payment through major debit/credit cards, Apple Pay, Paypal, and Google Pay. No charges are applied for debit/credit cards, and JAM Activity Camps does not store any card details.
1.4 Clear all balances before the camp starts to avoid potential cancellations.
2. PRICING, DISCOUNTS & OFFERS
2.1 Current pricing is transparently displayed on the JAM Activity Camps website, indicating savings against the rack rate. The rack rate is the normal pricing before applying any discounts, usually used in cases of limited availability or within the week of delivery.
2.2 Dynamic pricing calculates prices based on existing capacity. Booking early is encouraged with promotions. While the current price may be lower than the original payment, retrospective application of offer prices is not possible, and no refund on the difference is provided.
2.3 Any discount codes must be applied at the time of booking and cannot be applied retrospectively.
3.1 JAM Activity Camps reserves the right to surcharge published prices if the VAT rate exceeds 20% before the holiday commencement.
4. BOOKING AMENDMENTS AND CANCELLATIONS
4.2.1 Amendments or rescheduling up to 14 days in advance are possible, subject to availability. Any price difference must be paid. Amendments can occur only once and within the same calendar year.
4.2.2 No amendments or rescheduling within 14 days of the first day.
4.2.3 No illness protection is included for missed days.
4.3.1 Amendments or rescheduling can occur until one working day before the booking's first day, with no extra payment. Additional days or products added are charged at the advertised rate.
6. TERMS OF SERVICE
6.11 Late Collections: JAM Activity Camps operates between 0800 and 1700. Collections after 1700 will incur a £5 per child per five minutes charge. Persistent late collection may result in a child's exclusion.
7. COMPLAINTS
If issues arise during the camp, report them to the Camp Managers/Directors for resolution. Unresolved matters should be communicated in writing within 28 days after your child's final day, and efforts will be made to find a satisfactory solution.
8. LIABILITY
8.1 JAM Activity Camps' liability (excluding death or personal injury due to negligence) for any delay or failure to perform obligations is limited to the excess of the cost to you in the cheapest available market for similar services.
8.2 Except in cases of personal injury, illness, or death, liability is capped at twice the price (excluding insurance premiums and amendment charges).
8.3 JAM Activity Camps is not liable for consequential loss or damage, costs, expenses, or claims arising from the booking.
8.4 All warranties, conditions, or other terms implied by statute or common law are excluded to the fullest extent permitted by law.
8.5 You shall indemnify JAM Activity Camps against any loss, damage, costs, claims, or liability arising from your negligence or breach of contract, unless JAM Activity Camps is liable under these conditions.
9. PERSONAL PROPERTY
9.1 You and your child must take appropriate measures to protect valuables, baggage, or personal possessions.
9.2 JAM Activity Camps accepts no liability for loss or damage to personal property unless due to negligence.
9.3 Missing possessions should be reported to the Camp Manager immediately. Expensive or treasured items should not be brought to camp.
9.4 JAM Activity Camps does not accept responsibility for lost or damaged mobile phones. A strict no-mobiles-seen-or-heard-phone policy is enforced. Phones or other electronic items will be confiscated and returned to the child or parent at the end of each day.
10. FORCE MAJEURE
JAM Activity Camps is not liable for any delay or failure to perform obligations due to causes beyond its reasonable control, including but not limited to strikes, acts of God, war, terrorism, or pandemics.
11. PHOTOGRAPHY, MARKETING, AND THE INTERNET
11.1 To accurately represent the camps, JAM Activity Camps uses images of children in marketing materials. If you don't want your child's images used in future marketing, inform us on the form sent to you after booking.
11.2 Inappropriate use or sharing of camp images or videos is not allowed and may result in a child's exclusion.
12. DATA PROTECTION
Personal information collected during booking is stored digitally and used for fulfilling contractual obligations. Necessary information is shared with employees, agents, subcontractors, franchisees, and third parties. Security measures are in place to protect personal data. Refer to clause 11 regarding the use of photographs.
13. GENERAL
13.1 Headings in the conditions are for convenience and don't affect interpretation.
13.2 JAM Activity Camps may perform obligations or exercise rights through employees, agents, franchisees, subcontractors, or affiliates.
13.3 No waiver by JAM Activity Camps of any breach by you is considered a waiver of subsequent breaches.
13.4 Failure to exercise any power or insist on strict compliance does not constitute a waiver of rights.
13.5 Rights under the Contracts (Rights of Third Parties) Act 1999 are excluded, but this doesn't affect any rights or remedies of a third party.
13.6 If any provision is held invalid, it shall apply with the minimum variation necessary, and the remaining provisions shall remain valid.
13.7 The contract is governed by English law, subject to the jurisdiction of English courts.
